Permeable, SuDS-compliant driveways in Lowestoft
The planning rules for front gardens are stricter than most people realise, and the ground under this town is more varied than most people realise. This page covers both.
The five square metre rule
Since October 2008, householders in England have needed planning permission to cover more than five square metres of front garden with an impermeable surface that lets water run onto the road. The rule exists because paved-over front gardens push rainwater into road drains and sewers all at once, and it was introduced nationally after urban flooding made the cost of that obvious.
You do not need planning permission for a front drive of any size if the surface is permeable, or if runoff is directed to a lawn, border or other permeable area within the property. Government guidance on permeable surfacing of front gardens sets this out, and East Suffolk Council, the local planning authority for Lowestoft, applies the same national framework.
Why resin bound normally qualifies
A resin bound surface is porous by construction: water passes between the coated stones into the layers below. Laid over an open-graded stone sub-base and a porous binder course, the whole build-up acts as a sustainable drainage system, a SuDS build-up in the jargon, holding rainfall and letting it soak into the ground rather than sending it to the kerb. That is why a properly built resin bound drive normally falls within permitted development while a sealed concrete or standard tarmac drive over five square metres does not.
The qualifier "properly built" is doing real work in that sentence. Resin laid directly over sealed concrete is only as permeable as the concrete underneath, which is to say not at all, and then the drainage design has to route water to a soakaway or a permeable border instead. Lowestoft's ground: sand in some streets, clay in others
How well water soaks away depends on what is under the drive, and Lowestoft is a textbook for mixed glacial ground. The chalky boulder clay that blankets much of Suffolk is formally named the Lowestoft Till after this town, and the same ice age left beds of sand and gravel, including the Corton Sands named after the village just up the coast. In practice:
- Sandy ground, common towards the coast and in pockets across the town, drains freely and makes a full-infiltration SuDS build-up straightforward.
- Clay-rich ground holds water. A drive over the till may need a deeper stone sub-base to store rainfall while it soaks away slowly, or falls towards a lawn or planted border that takes the excess.
None of this stops a resin drive being built; it changes how the base and drainage are designed, and it is exactly the sort of thing a local installer checks with a test hole rather than assuming from the street name.
Conservation areas. Parts of the town sit inside designated conservation areas, including the South Lowestoft and Kirkley Conservation Area, which takes in Kirkley and parts of Pakefield, and the North Lowestoft Conservation Area around the historic High Street. Extra planning controls, including Article 4 directions, can apply to frontages there. What to ask for in a quote
If SuDS compliance matters for your drive, a good written quote should name the sub-base type and depth, say whether the binder course is porous, confirm the surface is resin bound rather than bonded, and state where water is expected to go. Those four lines are the difference between a drive that genuinely drains and one that merely looks like it should.
